The Type of Compensation Awarded in a Severance Package
Your employer's initial severance offer may be low. Many employers may undercut their first severance pay offer in hopes that the employee will accept, without question. However, you may be able to negotiate a larger severance package. Further, various potential unlawful practices by the employer during employment, such as retaliation, workplace discrimination, or a hostile work environment, may entitle you to more money than your company initially offers.
Common types of additional compensation in a severance package that may stem from unlawful employer practices during employment (such as wrongful termination or discrimination, for example) can include:
- Back Pay: This is all the money you would have earned if you weren’t unjustly fired. This can includes unpaid wages, vacation time, sick leave, health insurance, and pension benefits.
- Attorney Fees: You can request that your employer pay your attorney’s fees.
- Non-economic Damages: Payment to compensate for humiliation, pain and suffering, emotional distress and loss of reputation.
